Soil in its proper place is a valuable resource, however when soil enters the county's waterwyas in accelerated quantities, it is a pollutant, commonly referred to as sediment.

For more than forty years, the Bucks County Conservation District has worked to control the erosion of soil from both agricultural fields and development sites. A delegation agreement with the Pennsylvania Department of Environmental Protection to administer Title 25-Chapter 102 of the Pennsylvania Clean Stream Law enables the District to closely monitor earth disturbance within Bucks County.

Erosion and sedimentation control plans for any proposed earth disturbance in Bucks county exceeding one thousand square feet must be submitted to the District for review and approval. The engineered plans depict various erosion controls which must be installed to prevent soil particles from leaving the disturbed areas.

An NPDES (NOI) should be submitted in Bucks County to the District when earth disturbance will exceed one acre.

Expedited Plan Review Policy

As a result of the District’s workload and staffing, a plan submitted for review of adequacy for Chapter 102 (erosion and sediment control) can require up to 30 days to complete. In our effort to improve service, the District Board of Directors provides an Expedited Plan Review process, which allows an applicant with extenuating circumstances to request a speedier E&S plan review.

This process does not include General NPDES permits. Because of the mandatory 30-day comment period (required by Acts 67 and 68) that starts on the date of proof of receipt from the concerned municipality and the county Planning Commission, the General NPDES permit cannot be issued until the comment period has expired. In no case can a project needing an Individual NPDES permit be considered for an Expedited Review.

At the discretion of the District manager, an administratively/technically correct erosion and sediment control plan can be submitted for Expedited Review.

 Expedited Review procedure:

Prior approval of the District Manager in the form of a signed Expedited Review application. This form will be submitted along with the regular E&S Review Application form.

  • The applicant must submit two checks, one for the normal E&S review fee and the other in the same amount for the Expedited Review, each check payable to the Bucks County Conservation District, or BCCD.
  •  After approved for expedition by the District Manager, and considered to be administratively and technically complete, the review will be conducted with in 5 working days.
  • If the plan is inadequate, the applicant will have 10 days to correct and resubmit it for a second review, again a period of 5 working days.
  • There is no additional fee for the first Expedited Review Re-submission, but any subsequent reviews will have a fee of 20 percent of the original Expedited Review fee.
  • An Expedited Re-submission Plan Review must include a copy of the original review letter, a memo detailing revisions and a plan with revisions highlighted.
  • An Expedited Plan re-submission that has not been returned within the  10 days will be considered terminated and the normal re-submission fees and 30 day review time would apply. 

    Expedited Reviews are usually conducted beyond normal working hours and do not interfere with normal plan review scheduling.  The Bucks County Conservation District reserves the right to suspend the Expedited Plan Review program at any time and without notice.  If you plan is not approved to be expedited the Expedited Fee check will be returned to you.

This form may be used by an applicant seeking to apply for either complete or partial operational control of earth disturbance activities at a site which are already authorized by either an Individual or General NPDES Permit.
Certification of Origin/Clean Fill
Applicants must use environmental due diligence to ensure that fill material on all projects qualifies as Clean Fill. All fill material must be used in accordance with the Department of Environmental Protection's policy "Management of Fill" document # 258-2182-773.
